Order Cancelation

Bulk, Custom Synthesis, and Special Order items are non-cancellable.


Returns

Products may not be returned for credit except with Carolina Chemical’s permission. You must obtain advance authorization from us prior to returning any products. Certain items and quantities may not be returned for credit or under any circumstances. These items include: chemicals that have passed their expiration dates, custom products, special orders, products missing labels or safety seals, products that may have been tampered with, custom synthesis orders and bulk orders. Any returned items must be returned within 30 days of purchase. You are responsible for the cost of shipment of products to be returned to us. We do not charge a restocking fee.


Damages

All claims for replacement or credit must be made within 10 days of receipt of goods. Items which are proven defective or non-conforming to our specifications will be replaced at no charge or, at our discretion, credit issued upon receipt of returned goods.  Carolina Chemical shall not be liable for any loss, damage or penalty as a result of any delay in or failure to manufacture, deliver or otherwise perform hereunder due to any cause beyond our reasonable control, including without limitation, unsuccessful reactions, act by you, embargo or other governmental act regulation or request affecting the conduct of our business, fire, explosion, accident, theft, vandalism, riot, war, strikes or other labor difficulties, lightning, flood, windstorm, delay in transportation, or inability to obtain necessary labor, fuel, materials, supplies or power.


Warranty and Quality Guarantee

All chemicals are guaranteed to conform to the specifications listed on our labels, in our catalog, and on our web site.


Applicable Law

Any action shall be brought exclusively in the federal and state courts located in North Carolina and you expressly agree to be subject to the jurisdiction and venue of such courts.


Buyers Use of Products

Carolina Chemical’s products are intended primarily for Industrial, laboratory, manufacturing and research use and, unless otherwise indicated on our invoice, other writings, or on product labels, are not to be used for other purposes, including, but not limited to as, or a component in, a food, drug, or medical device, in vitro diagnostic reagents or cosmetics as defined in the Federal Food, Drug and Cosmetic Act, nor as a pesticide as defined in the Federal Insecticide, Fungicide and Rodenticide Act, nor for any human, veterinary or household use. You acknowledge that the products purchased from us have not been tested for safety and efficacy in a food, drug, cosmetic or pesticide unless otherwise stated by us in writing furnished to you. You expressly represent and warrant to us that you will properly store, test, use, manufacture and market any products purchased from us and any final articles made from them in accordance with the practices of a reasonable person who is an expert in the field and in strict compliance with all applicable federal and state food, drug, device, and cosmetic and other relevant federal and state laws and regulations, now and hereinafter enacted. You agree that it is your sole responsibility to comply with all applicable local, state, federal and/or international laws and regulations within your jurisdiction. The hazards, physiological and toxicological properties of most of our chemicals have not yet been fully investigated and/or determined, therefore, all of our chemicals should be handled with the utmost caution when they are used, stored or during disposal. We make no guarantee of any results and assume no liability for damage to any person, persons or property resulting from incorrect handling, storage, usage or disposal of our products. We are not responsible for conditions and actions which are beyond our control. You further warrant that any final articles manufactured from our products shall not be adulterated or misbranded within the meaning of the Federal Food, Drug and Cosmetic Act and shall not be articles which may not, under Sections 404, 505, or 512 of the Act, be introduced into interstate commerce.

You acknowledge that our products are intended primarily for laboratory use and they may not be on the inventory of Existing Chemical Substances defined pursuant to the Toxic Substances Control Act (TSCA). We assume no responsibility to assure that products purchased hereunder may be used in a commercial application as defined under TSCA.

You have the responsibility to verify the hazards and to conduct any further research necessary to learn the hazards involved in using products purchased from us. You also have the duty to warn your customers of any risks involved in using or handling the products.

You agree to comply with instructions and product label, if any, furnished by us relating to the use of the products and not misuse the products in any manner.

If you are reselling our products you also have the duty to make sure your customers use our products according to our product labels, other writings, or invoices furnished. You will also insure none of your customers use our products for any food, drug, human, animal, household or pesticide use.
